NICE User Group Privacy Policy

The NICE User Group website (the "Website") and the NICE User Group Community Application (the "App") are operated by NICE Systems, Inc. ("NICE" or "Us" or "We"). The Website and the App shall be referred to collectively as the "NUG Platform". This document (this "Policy") describes how we process the Personal Data of the Website and App users (each, a "User", also referred to as "You"). This policy is a part of the NICE User Group Terms and Conditions (the "Terms") and is incorporated therein. Capitalized terms used in this Policy but not defined herein are defined in the Terms.
  1. What Personal Data is Processed and for What Purposes?
    NICE collects Personal Data from Users at several different points within the NUG Website or App. Some Personal Data is provided voluntarily by Users (some of it is required in order to be able to use the NUG Platform, and some of it is subject to your own choice), and part of the Personal Data is collected by NICE through various technical means integrated in the NUG Platform. Below you can find further details on the types of Personal Data we collect in each instance, and the purposes for which NICE will be using this Personal Data.
    1. Information that Users are required to provide upon Registration.
      1. In order to register to use the NUG Platform, Users must first complete the registration form on the Website. During registration a User is required to provide contact information: e.g., first and last name, business e-mail address, chosen password.
      2. We use this information to establish the User account, verify that You are entitled to create an account and participate in the NUG Platform, communicate with You in relation to the foregoing, and manage your access and use of the NUG Platform, contact the User via email about (1) services on the NUG Platform (2) issues related to the NUG Platform (3) issues concerning the User membership in the NUG Platform (4) inform of NUG members events, meetups and conferences (5) address issues raised by the User, help requested by Users, or otherwise to continue discussions initiated by the User and (6) NICE products related information that may be of interest to you as a member of the NUG community, such as when a product is being sunset, a new solution / version is being deployed, etc .
    2. Information that Users voluntary provide through their User Profile.
      1. Information that we may collect from you, if you choose to provide it through editing your User profile, may include: a photo or photos, company name, your work title, work address including city, state, country and zip code, role in Your company, industry, phone number, contact person at NICE Systems Inc. or any of its Affiliates (each, a part of, and together, the "NICE Group"), details regarding NICE Group products used and details with respect thereto, languages You speak, Your personal experience with NICE Group products.
      2. We use this information for the following purposes: allowing the other users of the NUG Platform to view Your profile information and interact with you by sending you a request to be added to their friends list on the NUG Platform, corresponding with You through the NUG Platform, search your profile based on the information you provided, correspond with you off the NUG Platform using the contacts you provide, search other Users, allow Chapter leaders to download Users' profile information of members of their own chapters, tailoring our newsletters to Your preferences
    3. Information that is generated through your active use of the NUG Platform.
      1. Through the use of the NUG Platform, We may process additional information related to your use of the Platform, depending on your use of the NUG Platform, such as: the amount of NUG points that you accumulate, your postings on forums or blogs, Ideas, job boards, events that you add to your calendar, chapter groups that you join, resources that you post, comments that you leave on other Users posts.
      2. We use this information to facilitate the use of the NUG Platform according to its functionality, to allow other Users to interact with you based on your actions in the NUG Platform, to encourage you to use the NUG Platform, to establish a community of NUG users, increase visibility of Users on the platform, encourage discussion and communication between the Users of NUG Platform. In addition we use this information to improve our products and market them more effectively to our prospect customers.
      3. Any information you provide through the NUG Platform functionality may be viewed by other members of the NUG community (except for your profile details that you may choose in your settings to not be visible, such as your photo). When your postings or other references to You in the NUG Platform are displayed for others to see, NUG website will display your profile. It is encouraged that you never provide any sensitive or private information. Only use your work contacts.
    4. Information that we collect through your use of the NUG Platform.
      1. When using the NUG Platform, whether through the Web or using the App, we collect data that is passively provided by you, either in relation to your use habits and meta data of your use of the NUG Platform (such as, frequency of use, duration of sessions, pages visited, duration of stay in certain pages, date/time stamp, IP address, browser type, ISP, referring/exit pages, number of clicks etc.), through our log file systems, or in relation to your browser, computer or mobile device information and IDs, IP address, through the use of cookies. Please see further information about this type of data under the section "Cookies".
      2. We use this information for the purpose of providing, developing, enhancing, customizing and improving the NUG Platform, based on the Users' preferences and usage patterns and interactions with the NUG Platform; perform research, as well as for analytical and statistical purposes (such as analyze trends, optimize user interface flow); detecting, preventing, or otherwise addressing fraud, security or technical issues. to provide offers and improve the content of the NUG website for each User.
    5. Please note that you have no legal obligation under any applicable law to provide NICE with any of the above information, and any information that you provide is subject to your will to provide it. However, if you do wish to use the NUG Platform, the information we collect under sections 1.1 and 5.1 is necessary for the facilitation of your use of the NUG Platform, and if you choose not to provide it, you understand that you will not be able to use the NUG Platform.
    6. You may edit your profile information, including deleting most of the data in the profile, any time you wish. Please note that in order to delete the following personal data from our data bases: your first and last name, user name, password and email address, you need to contact NICE as described in section 7.2 hereunder. Please note that any input of personal email to your profile information will render your account disabled unless otherwise agreed to by the NUG Platform administration.
    7. Please note that as described above, other members of NUG may view information you provide about yourself and your organization.
  2. How we share Users Data with Third Parties?
    1. We will process your email address through our emailing platform, which may be provided to us by a third party vendor.
    2. The personal data processed through the Website is shared with Our Website hosting provider only for the purpose of allowing the Website to properly work and functionality that requires invoking of personal data to work properly;
    3. Our data is being hosted on Google cloud services;
    4. We may also share information in order to (a) ensure compliance with any applicable law or regulation and (b) detect, prevent or otherwise address fraud or security issues; (C) in case of change in ownership of our Company by way of merger and/or acquisition, in which case all personal data processed by us will be transferred to the possession of our successor in interest.
    5. Other than as set forth above or as required by applicable law, We do not share any personally identifiable Information with third parties;
    6. Anonymous and aggregated information may be shared with other third parties for the purpose of improving our Services, conducting business analysis or other business purposes;
    7. NICE may disclose personal information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on NUG; (b) protect and defend the rights or property of NUG; or (c) act in urgent circumstances to protect the personal safety of NUG employees or agents, other Users or members of the public.
  3. Data Transfers and Global Processing under GDPR
    1. Why is Personal Data Transferred?
      1. As we operate globally, and NUG Platform users are from all over the world, we may on occasion allow any information collected through the NUG Platform, as detailed above, to be accessed and/or processed and/or transferred from/to countries other than Your own location. We may do this where data is accessed/processed:
      2. By companies within the NICE Group for operational, administrative and compliance purposes; located in Israel and the US primarily, but also in other locations;
      3. By our service providers, for the purposes we specified above under the chapter "With Whom We Share Information"; currently our service providers are processing the data in the US.
    2. Our Safeguards in performing such transfers across boundaries:
      1. Adequacy. Any transfers to NICE Group headquarters in Israel for the purpose of administrative and compliance purposes, are transfers on the basis of an adequacy decision made by the European commission.
      2. Model Clauses. With some of our processors, we use standard contractual clauses that are binding standards of processing of personal data committed to contractually by third parties processing information for us and on our behalf, such standard clauses are approved by the European Commission ("Model Clauses").
      3. Privacy Shield. Some of our processors are certified under the Privacy Shield framework, which serves as an acceptable measure to allow transfer of personal data from the EU to the US.
      4. Consent. In the absence of an adequacy decisions, Model Clauses, or Privacy Shield certification, Your consent. By using the NUG Platform, you agree and understand that your information may be transferred from the EEA or other countries in which you may be using the Application, to other countries outside your own location (including outside the EEA), and specifically to the USA. The transfer will be to such third parties as described under "How we Share Your Personal Data".
  4. How long do we hold your personal data?
    1. We retain the personally identifiable information that we collect from and about You through the NUG Platform for as long as You are a registered user, You have not requested to opt out of our mailing list, or requested deletion of your Personal Data, or subject to our retention policies as may be in place from time to time (which you may request more information on, as described in the section "Data Subject Rights").
    2. Uninstalling the App by itself does not constitute opt out of our mailing list, and you need to opt out specifically in order for your email to be removed from our mailing lists. Each communication that will be sent to you has an opt out link and each newsletter contains instructions from unsubscribing from the newsletter; if for any reason you cannot find it, please contact us as provided below.
    3. We may however retain and use personal information as necessary to comply with our legal and regulatory obligations, to resolve disputes and to enforce our agreements, and we may retain and use anonymous and aggregated information for performance reporting and analytic purposes and for product and service improvement without limitation.
    4. If you are an EEA User, You can request that your personal information be deleted, subject to the GDPR provisions (e.g., to the extent you have the right under the circumstances) by contacting Us as described in the section "Data Subject Rights".
  5. Cookies
    1. A cookie is a piece of data stored on a User's computer tied to information about the User. We only use session ID cookies. For the session ID cookie, once a user closes the browser, the cookie simply terminates. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to log into the NUG Platform (since it is a private network we must use a cookie to log You in).     1. The NUG website contains links to other sites. Please be aware that NUG is not responsible for the privacy practices of such other sites. We encourage Users to be aware when they leave the NUG website and to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies solely to information collected by this website.
    1. You may have the rights prescribed below in relation to personal data processed by us, subject to the specific laws applicable to your personal data, certain limitations and restrictions as set forth in applicable law, and depending on the lawful basis upon which the processing of your personal data is based. If you are an European Economic Area data subject, all of the following rights may apply to you.
      1. The right to be informed about how your personal data is being used;

  8. Notification of Changes
    If this Privacy Policy is changed, NICE will post those changes on this page and other places we deem appropriate so that Users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the version of this Privacy Policy under which the information was collected. If, however, we are going to use Users' personally identifiable information in a manner different from that stated at the time of collection we will notify users via e-mail. Users will have a choice as to whether or not we use their information in this different manner. In addition, if we make any material changes in our privacy practices that do not affect User information already stored in our database, we will post a prominent notice on the NUG Platform notifying Users of the change.

  10. Notification and Rights of Users who are California Residents Under CCPA
    1. Definitions.
      1. Business Purpose means a use of your Personal Information for our operational purposes and such other purposes as disclosed in section 1 hereinabove, which are (1) reasonably necessary and proportionate to achieve the operational purpose for which the personal information was collected or processed, or (2) for another operational purpose that is compatible with the context in which the personal information was collected. For the avoidance of doubt, using your personal information for marketing to you is not a Business Purpose.
      2. CCPA means California Consumer Privacy Act OF 2018.
      3. Personal Information means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, of California Residents, as more fully defined by CCPA.

  11. California and Delaware "Do Not Track" Disclosures
    1. California and Delaware law require to indicate whether We honorDo Not Track" settings in your browser concerning targeted advertising. NICE adheres to the standards set out in this Privacy Notice and does not monitor or respond to Do Not Track browser requests. NUG is not using any advertising features on the Platform and therefore there is no tracking by default.

    1. We do not knowingly collect or solicit personal data from anyone under the age of 13. If you are under 13, please do not attempt to register for the NUG Platform or send any Personal Data about yourself to us. If we learn that we have collected Personal Data from a child under age 13, we will delete that information as quickly as possible.   13. Video and Photography
    1. 13.1. Please be aware that NICE will be taking photographs and video in public areas of any events it may arrange to NUG Platform members ("NUG Events") (session rooms, Exhibit Halls, etc.). We may use such media in marketing materials, educational products and publications. Your image and the sound of your voice may be recorded. If you are identified during the recording, or identify yourself by name, that information may be included in our materials. Recordings may be edited, copied, exhibited, published or distributed.
    NICE complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, retention of personal data transferred from European Union member countries to the United States. NICE has certified to the Department of Commerce that it adheres to the Privacy Shield Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.     It is important to note, however, that NUG Platform may be operated via servers situated in the United States and elsewhere. If you are located outside of the United States, please be aware that any information which you supply to NICE (including, without limitation, personal data [e.g., your name, phone number, email address, etc.]) may be transferred to, processed, and used in the United States and elsewhere. By accessing and/or using the NUG Platform, you irrevocably and unconditionally consent to the transfer, processing, and use of such information in accordance with this Privacy Policy.
